How will my personal injury claim be funded?

What is a conditional fee agreement?

A conditional fee agreement, also known as a ‘no win, no fee’ agreement is an arrangement between you and your personal injury solicitor. It means that if your compensation claim is unsuccessful, you will not have to pay a fee for your lawyer’s services.

How does a 'no win no fee' claim work?

In a ‘no win, no fee’ agreement, your lawyer will not charge you a fee if the claim is unsuccessful and may advise that an insurance policy is taken out on your behalf at the start of your case to cover costs such as court fees, medical report fees and your opponents’ costs if you are ordered to pay them.

What happens if my 'no win no fee' claim is successful?

Should your compensation claim with Thompsons Solicitors be successful, the majority of the legal costs incurred, such as basic fees, will be recovered from the person or company responsible for causing your injury or disease.  There may be payments to be made at the end of the case.  This will sometimes include a ‘success fee’, which is a percentage of the basic costs recovered and reflects the risk Thompsons took that the claim may not have been successful with no legal fees payable. The success fee is capped at 25% of the compensation awarded for injury and past losses (not future losses).  In addition the premium for any after the event insurance policy will be deducted.  There may be other deductions which will be fully explained when you enter the agreement with us.

How do I know if my compensation claim will be successful?

Thompsons Solicitors’ personal injury specialists will only advise you to start a compensation claim if you have a reasonable chance of securing compensation. If for any reason your claim is unsuccessful, Thompsons Solicitors will not charge you for its work on your case.
